Compass Motorcycle Excellence – Client and Instructor Liability and Motorcycle Insurance

Compass Motorcycle Excellence is committed to providing professional, responsible and safety-focused motorcycle training. This statement sets out the insurance and liability responsibilities of Compass Motorcycle Excellence, its instructors and its clients.

Business Insurance

Compass Motorcycle Excellence maintains Public Liability Insurance and Professional Indemnity Insurance appropriate to the provision of motorcycle instruction.

Public Liability Insurance provides cover in respect of certain claims arising from injury to third parties or damage to third-party property for which the business may be legally liable. Professional Indemnity Insurance provides cover, subject to the terms, conditions and exclusions of the policy, in relation to certain claims arising from professional instruction or advice.

These policies do not replace the requirement for a client or instructor to maintain their own legally compliant motorcycle insurance.

Client and Instructor Motorcycle Insurance

Every client and instructor who rides a motorcycle during training must ensure that the motorcycle being ridden has a current, valid motorcycle insurance policy that is valid for use in the United Kingdom.

The policy must provide, as a minimum, Third Party Liability cover and must specifically permit the motorcycle to be used for the relevant training activity on UK roads.

UK law requires vehicles used on public roads to have at least third-party insurance covering injury or damage to third parties.

It is the responsibility of the individual rider to check directly with their insurer that their policy provides the required cover. Clients and instructors must not rely on an assumption that their normal motorcycle insurance automatically covers training or instructional use.

Disclosure to Insurers

Clients and instructors are responsible for providing their insurer with all information required by the insurer when obtaining, renewing or amending their motorcycle insurance.

This includes, where applicable:

  • Motorcycle modifications and accessories;

  • Previous insurance claims or incidents;

  • Penalty points and motoring convictions;

  • Driving or riding disqualifications;

  • Any other material information requested by the insurer; and

  • The intended use of the motorcycle, including participation in motorcycle training where required by the insurer.

Failure to provide accurate and complete information may affect the validity or extent of insurance cover and may affect the handling or settlement of a subsequent claim.

The rider is responsible for confirming that all modifications to the motorcycle have been correctly declared to their insurer and that the motorcycle remains appropriately insured, legal and roadworthy.

Client Responsibility

Before participating in training, each client must ensure that:

  1. They hold the appropriate motorcycle licence or entitlement for the motorcycle being ridden;

  2. The motorcycle is legally permitted and suitable for use on UK roads;

  3. The motorcycle is correctly insured for the intended training activity;

  4. The insurance policy is current and valid;

  5. Any modifications, claims, penalties, convictions or other relevant circumstances have been properly disclosed to their insurer; and

  6. They comply with all applicable road traffic legislation and the requirements of their insurance policy.

Clients remain responsible for their own motorcycle, personal possessions and any loss or damage that is not covered by Compass Motorcycle Excellence's insurance.

Instructor Responsibility

Instructors must also maintain appropriate and valid motorcycle insurance for any motorcycle they ride during training. Where an instructor uses their own motorcycle, they remain responsible for ensuring that their insurance provides appropriate cover for their professional instructional activities.

Compass Motorcycle Excellence's Public Liability and Professional Indemnity Insurance does not constitute motor insurance for a client's or instructor's motorcycle.

Limitation of Liability

Nothing in this statement is intended to exclude or restrict liability where doing so would be unlawful. Any liability of Compass Motorcycle Excellence or its instructors is subject to applicable law and the relevant insurance policy terms, conditions and exclusions.

Clients and instructors are expected to take reasonable care for their own safety and the safety of other road users and to follow applicable road traffic law and the instructions given during training.

By participating in motorcycle training, clients acknowledge their responsibility to ensure that they are appropriately licensed, insured and legally entitled to ride the motorcycle used for training.

Compass Motorcycle Excellence recommends that clients contact their motorcycle insurer before training if they are uncertain whether their policy covers motorcycle training or any particular modification or use of their motorcycle.
